When the state writes letters to landlords: What does the Berlin rent scan really mean?

The Berlin Senate is breaking new ground in the control of the housing market. A rent index is deliberately designed as a guide. It shows average values for comparable flats and takes numerous characteristics into account, such as the year of construction, size, amenities, and location. Nevertheless, assessing a specific flat often remains complex. While a qualified rent index does have a legal presumption of validity, it does not replace an individual assessment. In the event of a dispute, the courts will continue to make the final decision.

Particularly with high-quality, modernised existing apartments, unusual layouts or special features, the actual market value often cannot be determined solely on the basis of standardised data.

The challenge for owners

Many private landlords are investing significant sums in modernising their properties. New windows, high-quality bathrooms, designer kitchens, energy-efficient renovations, or extensive floor plan changes significantly increase the living quality. At the same time, standardised datasets do not always fully reflect these special features.

Owners may need to justify why their specific flat deviates from the calculated comparative value. This is precisely why it is advisable to carefully document modernisation measures, fitting features and value-enhancing investments. These may be decisive in individual cases if the reasonableness of a rent needs to be demonstrably justified.

More regulation or more housebuilding?

However, the actual political discussion extends far beyond individual letters. Berlin has been suffering from a significant housing shortage for years. At the same time, approval processes often take many months or even years. New construction projects are postponed or can no longer be economically realised.

Against this background, a legitimate question arises: What measures actually create additional housing?

Representatives of the real estate industry have been pointing out for years that a sustainable relaxation of the housing market can be achieved primarily through faster permits, more new construction, and reliable framework conditions for investors. Controls can help enforce existing laws. However, they do not create a single new home.

In the long term, the Berlin housing market will only ease if sufficient new housing is created and investments in existing properties remain economically attractive.
